    Default Local government is using pages out of the communist bible!

    I can not fully describe the events of the last two days! I sit here exhausted and want to do nothing other than go to bed and hope that what has happened in the last two days was all a dream. Is is not on a scale of what has happened on the gulf cost or someones home getting destroyed buy a tornado or fire but is in some ways worse because it was a deliberate act by a local government that used there powers to do as they wished.
    My former father in-law a man I have loved and thought of as a second dad for as long as I can remember has been in a battle with the local government about the state of his property for some time now. He is a good man and will help you any way he can. One of thoughts people that if you are hungry will give you something to eat even if he has not enough for himself. He has given shelter to people that has needed it and much more.
    He has been a farmer all his life. Worked the family farm and when parents pasted away his siblings that are not vary nice people forced him to his small land next door. He has tried to do some type of farming on his own property even if it was to raise chickens and a few pigs for home use. He is seventy two years old.
    He is not one to discard things he finds has some value. Some people think of it as junk, and to tell you the truth some it was, but not all. Antique farm machinery that is older then he is and in good running order is vary valuable. Tractors with there implements that were valued 5-10 thousand dollars each. Tools of all kinds, trailers that were road worthy and so much more that has true value to them. These with everything else you can Imagen around a house. Kids swing sets, dog houses, lawn ornaments, retaining wall block new and stacked for use, working lawn mowers to cut the grass. All these and literally thousands of dollars of things gone!
    He was told to clean up but never as to what had to go or anything specific. Always vary vague. Go into your house or hard and Cleon up all the junk. If I told you this what would you say and do. Is that lawn mower that is broken, needs a part for the deck to get it working again junk? It is if a naibher does not like the way it looks! It is to old get a new one.
    He was told that if it was in a shed it could stay no matter what it was. Then told the shed has to go. He asked what do I have to do to the shed or building to keep it. He complies. Then he is told he has to do something else. He again complies and told that is good enough to keep the buildings, so he keeps his belongings in them.
    He is told after a long time that the next day a salvage crew will be there to clean up the property. They come. Every building that he was told he could keep they tore down! Worse the building was gone then everything that was in it was in sight and was then taken and put in trailers and taken to the land fill. That is except the tools that they picked out and was seen putting in there trucks to be divided later! This I seen with my own eyes! Everything but some odd machinery three tractors but without there implements that add to there value, some lawn mowers, and an amount of stuff that would fit in to the back of a pick up is left! He lives on five acres and the only thing that is there is a house and a small pole shed! So much for only cleaning up the junk!
    Now to tell the real reason this all happened! His siblings own the property around him. The town Will be making a subdivision around his property in two years. His siblings can't sell there property for the subdivision unless the acreage that is my fathei inlaws laws is added to it. The town can't take it out rite or rezone it if he still lives there. He does not have any money. He lives on his social security check. Lawyers would not fight for him because there wasn't any money in it for them. Now that they did this they will tell him pay up for the cost of the clean up or we put it on your taxes. He will not be able to pay the taxes on this! They will then take the property and for close on it. I can tell you who will buy it and settle up the taxes on the land but I think you can figure it out!
    This has ruined him! He has nothing left. I fear for him, for he has said there is nothing to live for! I tell him he has the rest of his family and my two sons that he loves dearly! I truly think this so far is the only reason he is still here.
    I am sorry this is so long but as some of you know, I think of pachitalk as part of my family. This is only a small part of the story and could have helped himself out by not being so stubborn but in the end he could have complied as much as they wanted they would still have did this. They have an agenda and it has nothing to do with how clean his property was. The local government has so much power over a landowner it is almost unreal! The only thing different between a communist state and how this has gone down is that the communist state would have just taken the land and not bothered to make it look legit! Lazarus.

    a law was recently passed stating that the governement cant take someone's property as long as they pay the owner a fair amount for the value if the piece of property is going to benefit the community as a whole. Sounds like this is something like they are trying to do. It's very unfair and I disagree with it. I hope for the best for this man and hopefully something positive and beneficial for him will come out of this especially since this is what he has grown up on and pretty much it sounds like this is all he knows. Once again I wish him the best of luck. By the way, had he looked into getting a DA (district attorney) to represent him? I think they state would provide one for him.

    Well, our liberal activist Supreme Court has now decided that government can take your property at any time under Eminent Domain. Hey, if they can get more taxes from a developer or whomever, then they can just tell you to get out and give the property to the other person. Yes, we are going down a very slippery slope these days. The socialists are making big inroads and things are not looking good. The socialists use the courts to make laws that would never make it by Congress. Here is an example currently going on in Iowa. Coming soon to your town.

    The move would be the city's first use of a U.S. Supreme Court-granted power to wrest control of private property and put it in the hands of developers as a way to boost the tax base.<O></O>

    <O></O>

    Property rights advocates warn the action could pave the way for countless forced property sales.<O></O>

    "I'm going to fight tooth and nail," said Brad Hamilton, who owns 422 and <st1:Street w:st="on"><st1:address w:st="on">424 E. Locust St.</st1:address></st1:Street> — a T-shirt printing business and ZZZ Records. His buildings "impair the redevelopment" of the <ST1lace w:st="on"><st1laceName w:st="on">East</st1laceName> <st1laceType w:st="on">Village</st1laceType></ST1lace>, according to city officials.<O></O>

    The <ST1lace w:st="on"><st1laceName w:st="on">East</st1laceName> <st1laceType w:st="on">Village</st1laceType></ST1lace> in the past five years has been transformed from a mix of buildings, some vacant, to a collection of shops, restaurants, loft apartments and condominiums.<O></O>

    The improvements received a helping hand when the city pumped more than $11 million into the area just west of the Capitol for aesthetic improvements and developer incentives.<O></O>

    <st1:City w:st="on"><ST1lace w:st="on">Hamilton</ST1lace></st1:City>'s buildings passed an inspection in 2000.<O></O>

    <O></O>

    But city officials in 2002 set guidelines for renovations and targeted about a dozen <ST1lace w:st="on"><st1laceName w:st="on">East</st1laceName> <st1laceType w:st="on">Village</st1laceType></ST1lace> buildings. Owners who failed to make improvements were told they would face eminent domain, which is the government's power to force land sales when property is considered necessary for public improvements.<O></O>

    "The idea is to save these buildings," the assistant city manager, Rick Clark, said at the time.<O></O>

    Most of the property owners have completed major renovations. City leaders, however, say <st1:City w:st="on"><ST1lace w:st="on">Hamilton</ST1lace></st1:City>'s buildings and a third, at 434 E. Locust owned by Kirk Blunck, "remain in a blighted condition."<O></O>

    <O></O>

    <st1:City w:st="on"><ST1lace w:st="on">Hamilton</ST1lace></st1:City> submitted a plan in April for $12,000 in repairs. City officials said it lacked detail.<O></O>

    <O></O>

    Clark sent letters on Aug. 26 that gave <st1:City w:st="on"><ST1lace w:st="on">Hamilton</ST1lace></st1:City> and Blunck 10 days to act. The letters did not mention specifically what needed to be fixed, but Blunck responded with a plan for almost $105,000 of improvements within the next year.<O></O>

    <st1:City w:st="on"><ST1lace w:st="on">Hamilton</ST1lace></st1:City> initially balked, but plans to meet again with city officials this week.<O></O>

    The buildings were boarded up when he purchased them about five years ago. <st1:City w:st="on"><ST1lace w:st="on">Hamilton</ST1lace></st1:City> says he has already updated plumbing, electrical work and floors, in addition to outside work on the buildings' facades.<O></O>

    He believes influential people who want his property have pressured city leaders to harass him.<O></O>

    "Do you think I'm going to let them steal my property? No way," he said.<O></O>

    <O></O>

    Clark last week acknowledged that work has been done on <st1:City w:st="on">Hamilton</st1:City>'s buildings but said the improvements pale in comparison to others in the <ST1lace w:st="on"><st1laceName w:st="on">East</st1laceName> <st1laceType w:st="on">Village</st1laceType></ST1lace> area.<O></O>

    "I think what we're really looking for is a plan," <ST1lace w:st="on">Clark</ST1lace> said. "I haven't personally gone through the buildings so I'm not sure exactly what all the conditions are inside."<O></O>

    Attorney Bill Lillis represents several property owners in the <ST1lace w:st="on"><st1laceName w:st="on">East</st1laceName> <st1laceType w:st="on">Village</st1laceType></ST1lace>, including Iowa State Bank Chief Executive John Burgeson and Basil Prosperi Bakery's Steve Logsdon.<O></O>

    Lillis urged the council on June 6 "to move without delay" and force <st1:City w:st="on"><ST1lace w:st="on">Hamilton</ST1lace></st1:City> to make additional improvements.<O></O>

    Lillis on Aug. 17 submitted a client's offer to buy <st1:City w:st="on"><ST1lace w:st="on">Hamilton</ST1lace></st1:City>'s properties. <st1:City w:st="on"><ST1lace w:st="on">Hamilton</ST1lace></st1:City> turned down the $450,000 offer.<O></O>

    City Councilman Archie Brooks said he will propose action within the next month to move forward with eminent domain proceedings.<O></O>

    <O></O>

    He said the $450,000 offer is far more than what the city will give <st1:City w:st="on"><ST1lace w:st="on">Hamilton</ST1lace></st1:City>. The properties are valued at $206,000, up almost $70,000 since 2001, according to county records.<O></O>

    "We're not asking him to do anything else than what others have already done," Brooks said. "We're not going to let this die. We've got people standing in line to buy those buildings over there."<O></O>

    <O></O>

    Eminent domain powers for generations were used almost exclusively to force land sales for roads, bridges and public buildings, said Adrian Moore of the Reason Foundation, a nonprofit policy group in <st1:City w:st="on"><ST1lace w:st="on">Los Angeles</ST1lace></st1:City>.<O></O>

    Politicians abuse the power to achieve goals that have nothing to do with the public good, <st1:City w:st="on"><ST1lace w:st="on">Moore</ST1lace></st1:City> said this summer, shortly before the U.S. Supreme Court ruled in a 5-4 decision that cities can use eminent domain to help economic development.<O></O>

    "Taking people's property away for a public interest is one thing, but taking it away to give to another use that will pay more taxes is terrible," <st1:City w:st="on"><ST1lace w:st="on">Moore</ST1lace></st1:City> said. "That means that nobody's property is safe."<O></O>

    At least six <st1laceName w:st="on">East</st1laceName> <st1laceType w:st="on">Village</st1laceType> property owners declined to comment specifically about <st1:City w:st="on"><ST1lace w:st="on">Hamilton</ST1lace></st1:City>'s situation, but none acknowledged complaints about the property. Brooks and Clark say they have received frequent complaints.<O></O>

    Property owner Bill Sexton said the beauty of the neighborhood is its eclectic mix of historic buildings and businesses, such as <st1:City w:st="on"><ST1lace w:st="on">Hamilton</ST1lace></st1:City>'s record store.<O></O>

    "I've been in that building and it's not in bad condition," he said.<O></O>

    <O></O>

    Bryan Smith, manager of Blazing Saddle at <st1:Street w:st="on"><st1:address w:st="on">416 E. Sixth St.</st1:address></st1:Street> and a board member of the <st1laceName w:st="on">East</st1laceName> <st1laceType w:st="on">Village</st1laceType> neighborhood association, said his group has no problem with the condition of <st1:City w:st="on"><ST1lace w:st="on">Hamilton</ST1lace></st1:City>'s buildings. He said he is troubled by the city's threats.<O></O>

    "If they deem it viable to do something else with your building, they can consider anything an eyesore," Smith said. "Really, nobody is safe and especially the small people and business owners like us."

    Yes, they have to pay "fair value" (and who decides that?) but that isn't the point. Is it government that should decide if you can keep your property or not? This nation was founded on the right of property. A man's home is certainly no longer his castle.

    On Jan. 10, 1963, Congressman Albert S. Herlong Jr. of Florida read a list of 45 Communist goals into the Congressional Record. The list was derived from researcher Cleon Skousen’s book “The Naked Communist.” These principles are well worth revisiting today in order to gain insights into the thinking and strategies of much of our so-called liberal elite.


    1. U.S. should accept coexistence as the only alternative to atomic war.


    2. U.S. should be willing to capitulate in preference to engaging in atomic war.


    These encapsulate the Kennan Doctrine, which advocated for the "containment" of communism. Establishment figures supporting the amoral containment policy at least implicitly worked with the communists in scaring the wits out of the American people concerning atomic war.


    President Ronald Reagan undid the doctrine when he took an aggressive stand against the Evil Empire by backing freedom fighters from around the world that were struggling against the left-wing communist jackboot. As a result, the Soviet Union and its satellites imploded, a considerable and unexpected setback to the international communist edifice.


    3. Develop the illusion that total disarmament by the U.S. would be a demonstration of "moral strength."


    The nuclear freeze advocates supported a freeze on American nuclear development only. Rarely were Soviet nukes or those of other nations mentioned in their self-righteous tirades. The same advocates now call for reducing American military might, claiming that there is something immoral about America preserving its military pre-eminence in the world.


    4. Permit free trade between all nations regardless of Communist affiliation and regardless of whether or not items could be used for war.


    Today, there are calls to end the embargo on the slave island of Cuba, there were complaints about the embargo against Iraq, and the U.S., not Saddam Hussein, was blamed for the suffering of the Iraqi people. Would they have advocated for free trade with Hitler and his National Socialist regime?


    5. Extend long-term loans to Russia and Soviet satellites.


    6. Provide American aid to all nations regardless of Communist domination.


    Such aid and trade over decades contributed greatly to the left-wing communist liquidation of over 100 million people worldwide, according to the well-documented "Black Book of Communism."


    This aid and trade marks a shameful chapter in American history. Without the aid and trade, the left-wing international communist behemoth would have imploded on its own rot a lot sooner and umpteen millions would have been saved from poverty, misery, starvation and death.


    7. Grant recognition of Red China and admission of Red China to the U.N.


    Not only did President Jimmy Carter fulfill this goal but he also betrayed America’s allies in Nicaragua, El Salvador, Iran, Afghanistan, Angola and elsewhere.


    8. Set up East and West Germany as separate states in spite of Khrushchev's promise in 1955 to settle the Germany question by free elections under supervision of the U.N.


    9. Prolong the conferences to ban atomic tests because the U.S. has agreed to suspend tests as long as negotiations are in progress.


    10. Allow all Soviet satellites individual representation in the U.N.


    11. Promote the U.N. as the only hope for mankind. If its charter is rewritten, demand that it be set up as a one-world government with its own independent armed forces.


    There are still American intellectuals, and elected members of Congress, who dream of an eventual one world government and who view the U.N., founded by communists such as Alger Hiss, the first secretary-general, as the instrument to bring this about.


    World government was also the dream of Adolf Hitler and J.V. Stalin. World government was the dream of Osama bin Laden and the 9/11 hijackers.


    12. Resist any attempt to outlaw the Communist Party.


    13. Do away with loyalty oaths.


    14. Continue giving Russia access to the U.S. Patent Office.


    While the idea of banning any political party runs contrary to notions of American freedom and liberty, notions that are the exact opposite of those held by the left-wing communists themselves, nevertheless these goals sought to undermine the constitutional obligation of Congress to investigate subversion. The weakening of our government’s ability to conduct such investigations led to the attack of 9/11.


    It is entirely proper and appropriate for our government to expect employees, paid by the American taxpayer, to take an oath of loyalty.


    15. Capture one or both of the political parties in the U.S.


    In his book "Reagan’s War," Peter Schweizer demonstrates the astonishing degree to which communists and communist sympathizers have penetrated the Democratic Party. In his book, Schweizer writes about the presidential election of 1979.


    16. Use technical decisions of the courts to weaken basic American institutions, by claiming their activities violate civil rights.


    This strategy goes back to the founding of the American Civil Liberties Union by Fabian Socialists Roger Baldwin and John Dewey and Communists William Z. Foster and Elizabeth Gurley Flynn among others.


    17. Get control of the schools. Use them as transmission belts for Socialism and current Communist propaganda. Soften the curriculum. Get control of teachers associations. Put the party line in textbooks.


    18. Gain control of all student newspapers.


    19. Use student riots to foment public protests against programs or organizations that are under Communist attack.


    The success of these goals, from a communist perspective, is obvious. Is there any doubt this is so?


    20. Infiltrate the press. Get control of book review assignments, editorial writing, policy-making positions.


    21. Gain control of key positions in radio, TV & motion pictures.


    22. Continue discrediting American culture by degrading all form of artistic expression. An American Communist cell was told to "eliminate all good sculpture from parks and buildings," substituting shapeless, awkward and meaningless forms.


    23. Control art critics and directors of art museums. " Our plan is to promote ugliness, repulsive, meaningless art."


    24.Eliminate all laws governing obscenity by calling them "censorship" and a violation of free speech and free press.


    25. Break down cultural standards of morality by promoting pornography and obscenity in books, magazines, motion pictures, radio and TV.


    26. Present homosexuality, degeneracy and promiscuity as "normal, natural and healthy."


    This is the Gramscian agenda of the "long march through the institutions" spelled out explicitly: gradual takeover of the "means of communication" and then using those vehicles to debauch the culture and weaken the will of the individual to resist.


    Today those few who still have the courage to advocate public morality are denounced and viciously attacked. Most Americans are entirely unwitting regarding the motives behind this agenda.


    27. Infiltrate the churches and replace revealed religion with "social" religion. Discredit the Bible and emphasize the need for intellectual maturity, which does not need a "religious crutch."


    This has been largely accomplished through the communist infiltration of the National Council of Churches, Conservative and Reform Judaism, and the Catholic seminaries.


    28. Eliminate prayer or any phase of religious expression in the schools on the grounds that it violates the principle of "separation of church and state"


    Replacing belief in the creator with belief in the earthly man-controlled State.


    29. Discredit the American Constitution by calling it inadequate, old fashioned, out of step with modern needs, a hindrance to cooperation between nations on a worldwide basis.


    And replace our nation of "laws, not men" with royal decree emanating from appointed judges and executive orders. Replace elected officials with bureaucrats.


    30. Discredit the American founding fathers. Present them as selfish aristocrats who had no concern for the "common man."


    31. Belittle all forms of American culture and discourage the teaching of American history on the ground that it was only a minor part of "the big picture." Give more emphasis to Russian history since the Communists took over.


    Obliterating the American past, with its antecedents in principles of freedom, liberty and private ownership is a major goal of the communists then and now.


    32. Support any socialist movement to give centralized control over any part of the culture – education, social agencies, welfare programs, mental health clinics, etc.


    Public ownership of the means of production, the core principle of totalitarianism.

    Eminent Domain was originally meant to take property & land in order to be able to build roads, etc (stuff for the good of the community, in other words); however, it now has come to be interpreted to mean that it can be used so private developers can build subdivisions. This is so wrong.
    There has got to be free legal help out there for him.

    I also meant to add to my post that this new interpretation of Eminent Domain has NOTHING to do with communism- it has to do with greed= pure unadulterated political greed for political ends. Nothing more. Nothing less.
    In other words, ..."if I, Mr Local Politico, can condemn & take YOUR property so MY bedbuddy, Mr BigTimeLandDeveloper, can get it & make MEGABUCKS from it, MY bedbuddy will then contribute lots&lost&lotsamoney to MY campaign so I can buy lots&lots&lotsa airtime & newspaper ads so I can dupe the rubes into voting me back in office. Hey, its a win-win situation, right? Why, it's the American Way!"...
