I think ebay will follow through if a complaint is made. I once busted a guy for shill bidding on a car I was interested in. He had two other user IDs that he used to pad the bidding on his items. Ebay shut down the auction I was viewing within 12 hours.

Maybe Milt gave his permission to use the image... maybe not.
That's up to him to decide.
But I would expect the ad to be removed anyway, for lack of eBay's mandatory "disclaimers".
