    Ohio Seller as of May 6 need Auctioneer's license to sell on ebay.

    The ohio assembly changed the law, on feb. 1 ohio gov. Bob Taft signed S.B. 209, which redefine Ohio 's governance of auctions, but an unintebded consequence could force people selling items on ebay to get an Auctioneer's license, just like those that do live auctions.

    Unless they act to change the law before May 6. Anyone sell without a Auctioneer's license is breaking the law. The Ohio Department of Agriculture oversees the Auction licenses and would enforce the new Legislation.

    Auctioneer's license requires:
    one year apprenticeship
    preform as bid caller in 12 auctions
    attend an approved auction school
    pass oral & written test
    pay Auctioneer's license fee of $200.00 a year
    post $50,000.00 bond
    establish an escrow account (buyer's protection)

    The Ohio Auctioneer's Association is all for the law.

    Surely, they will modify this new law so people can continue to sell on eBay? We're all a LOT better off when these politicians are on recess and not out making crazy new laws.

    It's un-enforceable to the general publis selling from home. Online gambling is also against the law. Just no way to enforce it and no interest to try.

    Couldn't thay ask ebay for a list of ohio sellers ?

    Do you think ebay would say no ?

    If they don't enforce the law, will Ohio Auctioneer's Association complain about favor treatment ?

    It is very stupid law, from people with to much time on their hands.

    The primary author of the legislation, State Sen. Larry Mumper, told the paper the legislature never intended it to apply to individuals selling items over eBay. But Mumper, while vowing changes, couldn't say exactly who would or would not be exempt from the license requirement under any changes in the pending law.

    "It certainly will not apply to the casual seller on eBay, but might apply to anyone who sells a lot," he said. "If someone buys and sells on eBay on a regular basis as a type of business, then there is a need for regulation."

    Stupid law. We have way to much government and every day we loose more of our freedoms.

    So if you have mom staying at home so she can raise her kids and then has a side business on ebay selling things to make a little extra money, she is now going to have to have a license.
