    After looking at this guy I really am not that worried. Who in their right mind would bid on one of his auctions after reading them.

    It's kind of fun to read his auctions. Gives me a good laugh.

    complaint to ebay may not be a good idea,

    h.d. may get mad

    i had someone swipe my pictures to sell stuff he didn't have. i complained to ebay and it didn't help.

    the guy never delivered what he had listed on ebay.

    Well he became an ebay member on 12/28/04. He's from Port Arthur, Texas.

    I'm going to search the userbase and see if I can find him. If he's here and stealing your graphics, he's not going to be here for long!

    Certainly the best thing to do is to watermark your pictures you put up on ebay. Secondly, add this script I used in my ads to keep people from right clicking on my ads and having fun with copy and paste.

    eBay will remove items that violate someone else's copyright or trademark. In the U.S. the requirements for claiming copyright are not as stringent as they were years ago. You used to have to actually file for a copyright and file copies of the work with the Library of Congress. I believe that these days every creative work is automatically covered by copyright - even if it does not contain the (c) mark and has not been filed with the library of Congress.

    So, you just file a complaint with eBay and they might remove this item. I think all they require is a formal statement signed by you.

    We have used this technique to get auctions removed for our audio components when they were being sold by unauthorized gray-market retailers. There was nothing we could do about them selling the product. But they used photos taken from our website in their listing. We claimed copyright on the photos, and the auctions were removed.

    In your case the tricky part would be that, while you can legitimately claim copyright on the artwork, unless you had the permission of trademark holders for both Harley and Betty Boop, by filing the copyright claim you call more attention to your own trademark violation.

    So, you've got a large chance of punishing this creep - which might deliver some satisfaction, but otherwise has no monetary value. But you also have a small risk that eBay may get curious, check with the trademark holds - who might just tell you to stop, but could also come down on you like a ton of bricks.

    So you've got to weight a big chance of a low value return vs. a small chance of ending up with a big expense.

    You most definitely NEED to report him!

    Ebay will listen to this. I once had someone use my picture and graphic and I simply filed a complaint with ebay letting them know and they pulled the other guys auction.

    Or you could get a completely new ID on Ebay...and bid high enough to win his stuff...and find out where he lives and kick the california outta him. :twisted: But that's just a woman with a bad case of PMS talking here!

    I am afraid to report him to ebay because I am using elements in my design (HD and Betty Boop) that I don't have permission for and ebay may look "further" into my auctions like gwarzin.

    I am wondering who in their right mind would bid on auctions from this buy anyway. If he seels this machine and then lists another one, then I will take action but I have good chance he might just "go away".

    I don't even know if this guy has made this machine yet. Looking at his auctions

    You can tell it is the exact same machine with the graphics photoshoped in.

    Who knows what kind of materials he uses and I am sure his quality is terrible if its the same as his english.

    Well I am off to New York for 5 days so I will have to deal with this guy when I get back.

    This guy is a freaking idiot.

    Here are 2 messages from him after I told him to stop stealing my graphics.

    "Hi I dont know were my brother got the idar for this photo but, i looks great,
    it was done in vekter and is done on a backlight film, dont know who you are and you dont own the bettey boop grafics,,
    so if you are useing this you are stilling it as well as the H-D logo,
    I have all the out law logos as well as i have right to use some.
    I my brother has been in the sighn bis for a long time and can make up any thing i want, with vinal as well as back lit reels and all. my other brother owns a big fabucation shop in LA.
    were he has some mexakens make up pull arms for free just to learn how it use the machines.
    i allso sell the auto stop boards with the cridet function that most dont sell and have about 300 avalable for my slots just to get the edge,
    any way i hope we can work together and not be fighting and all the rat bull $hit that i here gos on in the ebay foram, i dont want to spend my time like that,

    I sent him an email telling him I was interested in his Harley Slot and would like to see the document that shows the graphic was "registered and paid for". I told him if it was, I was willing to pay a lot of money. He didn't reply :lol:

    I Googled the phone he listed. Not there, but the area code he gave is for Southeastern Louisiana.

    dapper you will want to get on this asap as those people in Florida that do for 9.95 the belly and the top graphics for customizers will probably start mass producing these. At first I thought it was a compliment that he was copying you but now I see it is out right stealing. Go after him before it's too late.

    Might that draw retaliatory action? Seems like a little tip to Harley-Davidson could put the dapper one into a sticky situation, unless of course rights have been paid for use of their trademark. H-D is very protective of their property.

    While the graphics is a work of art better left unspoiled, a visible copyright notice, perhaps semi-transparent, would increase the difficulty in copying.

    EDIT:

    In further reading I see the issue of trademark or copyright infringement has been addressed. On the issue of some company mass producing these, I doubt a legitimate company would take the risk.

    I wouldnÂ’t worry about this guy too much. I doubt he will be around eBay too long. I donÂ’t know about others but I personally will not buy from someone on eBay claiming to be in business but who doesnÂ’t have enough sense to use a spelling or grammar checker. Obviously this guy canÂ’t even afford to pay someone (or know someone bright enough) to edit his ads if heÂ’s too stupid to do a reasonable job himself. This doesnÂ’t lend much credit to his business abilities IMHO.
