Yes, that is true. It is legal for them to sell a machine out of state. They can't sell to anyone in CA. I am not sure if they need a special license to sell them (as a vendor).

Yes they have to purchase a special license to bring them into the state and they can't sell them in the state as they aren't antiques.

    WOW!

I did not know that. I started searching for obscure laws and found that--
California Penal Code Section (CPC330.1) strictly prohibits the possession of slot machines or pachislo's.

I also found an even more obscure California Ruling prohibiting Laughing Smiling and / or having fun.

While searching for other obscure laws I found that "Mopery" is defined as the act of exposing yourself to a blind man,.

    ...JN

P.S. If you look on craigslist, you will that there are shops in San Leandro, Hayward, and San Mateo.

It is odd and true about the laws concerning the state of Komi-fornia. I actually deal with federal gaming agencies on a daily basis. I, in many respects am exempt from California gaming laws as I work / live in an area that has a compact with the state, so I deal only with federal laws and regulations - California state laws are not recognized and have no jurisdiction.

It still hits an interesting debate - Every Chuck-E-Cheese or Scandia mini golf and arcade would fall under this definition as well - Amusement machines were given a reprieve in 1972 in California (I think - Not sure, must look it up). This allowed pinball and eventually video games (allows for skill - no direct payout) to exist (and thrive) as amusement devices. There is no direct or indirect payout of currency or exchange medium for monetary gain so these became the allowable exception.

I would like to work on some more research in this area. This has definitely sparked my curiosity. I know very little about Pachislo. I know more about gaming regulations.

    - Is a Pachislo a true slot (chance, with programmable or predictable holds and odds) machine or does it involve user interaction / interface and skill or controls?

pachislos were in a grey area in Flordia, some ebay dealers wouldn't ship here then.

i do know of one instance where a container full was confiscated by the gov't a few years back.

i do see more of them listed on craigs list and for sale at flea markets now.

Interpretation of the law in these areas always seems to be just that - an interpretation. The weight of any action seems to lie with the party that feels more motivated (monetarily) to levy an imposition.

Arcade games and pinball are allowed (fall under an amusement tax).

Example: If machines go unnoticed, but are used in private or for amusement or provide a viable income for the state (tax) - commercial amusement, it presents a problem to no one. The instant any entity (State, private party or cop that had a bad jelly doughnut) feels that there is need for restriction (i.e. Someone see the reels of a "slot machine", feels that gambling is for "sinners" or has no idea what it is, but thinks it should be banned or restricted and gets it in their brain that it is an existing restricted item - true or not) you will have a problem involving confiscation and litigation.

In the state of CommieFornia you are guilty until proven that you need to be taxed or fined with slightly more leniency, but you are always guilty and should pay. The state of CommieFornia is never wrong, however, if the state happens to be slightly mistaken, and the possibility of incorrectness exists the mistake is always the fault of the offending party for not fully disclosing, knowing or offering all the information available, and is therefore guilty in all possible matters concerning the state of CommieFornia and should be made to pay all levies, fines and taxes in full, with interest, including penalties and fees.

awful taxes, incredibly expensive, litigious as all hell...but with the weather, the concerts, the food, and the history here in the san francisco bay area, i wouldn't live anywhere else in the country. born and raised here and i love it!

people everywhere are crazy, myself included. i may as well be with crazy people in nice weather where the vintage pachis are plentiful. the close proximity to fantastic wine doesn't hurt one bit either...

I do like the fact that where I live is close to everything. The mountains are two hours away in one direction, and the ocean is two hours away in the the other. If it weren't for the politics, taxes, smog, and crime I would be totally happy here.

As a fifth generation San Franciscan I can verify that all the craziness about California and especially the Bay Area is extremely tiring... but I couldn't imagine living anywhere else. It's some sort of sickness.

I just ordered my first machine, and the site I went through said nothing about these machines being illegal in California. It did say that they couldn't ship to Colorado and Louisiana. I don't suppose they'll be checking the fed-ex truck at the state line anyway.
